Legal aid asks financial institutions to help victims of Queen’s deed theft


A Queens man who lost his home to mortgage fraud is about to be kicked out of the house where he has spent most of his life.

64-year-old Johnny Jackson and legal aid societies attorneys are asking the Wilmington Trust, a division of M&T Bank, to stop the eviction and return the property deeds to Jackson.

“Our client fell victim to a massive mortgage fraud scheme that took away his most important asset, the family home. And now he’s being victimized again by the Wilmington Trust Bank. said Jennifer Levy, staff attorney for foreclosures for the Legal Aid Society’s Prevention and Homeowner Protection Unit.

A Wilmington Trust spokesman declined to comment.

According to the Legal Aid Society, since 2014, New York City has received more than 3,350 complaints of deed theft, in which property title was acquired without the owner’s knowledge or approval, making communities of color more vulnerable. It affects the imbalance.

Such scams have decreased in recent years. Last year, 154 complaints were filed with the Treasury, compared with 665 in 2015. However, during the 2008 financial crisis, deed theft was a persistent feature.

According to the Legal Aid Society, in 1994 Jackson bought the St. Albans home where he grew up from his parents, who had owned it since 1956. Jackson and his brother continue to live on the property, which at one point was wholly owned by Jackson.

According to the Legal Aid Society, Jackson’s problems began in 2010 when he took out a $108,000 loan to repair his home. The man who arranged Jackson’s loan was later convicted of a mortgage modification scheme involving more than 1,000 financially distressed homeowners.

According to the Legal Aid Society, as part of the fraud, Jackson’s house deed was illegally transferred to a “straw buyer” who bought the house on behalf of someone else. Unbeknownst to Jackson, Straw’s buyer took a mortgage on the house, withdrew the shares, and sent the property to foreclosure.

According to the Legal Aid Society, the Straw buyer gave up ownership of the property and transferred the deed to the Wilmington Trust. In 2019, the Wilmington Trust went to court and asked a judge to evict Jackson so he could own the house.
